The terms that apply when purchasing products and services from JOLLYLIGHT.
Scope
These General Terms and Conditions of JOLLYLIGHT (the “Seller”) apply to all contracts between a consumer or business customer (the “Customer”) and the Seller concerning the goods and/or services offered in the online store. The Customer’s own terms and conditions are excluded unless otherwise agreed.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or independent professional activity.
A business customer is any natural or legal person who, when entering into a legal transaction, acts in the course of their trade, business, or independent professional activity.
Formation of the Contract
Product descriptions in the online store do not constitute a legally binding offer. They are an invitation to place an order.
By completing the ordering process, the Customer submits a binding offer.
The Seller may accept the offer within five days by:
- Sending an order confirmation by email.
- Delivering the goods.
- Requesting payment.
The contract is concluded as soon as one of these actions takes place.
The acceptance period begins on the day after the order is placed.
The contract text is stored and sent to the Customer by email.
The Customer may correct input errors before submitting the order.
The language of the contract is German.
Communication takes place by email. The Customer must provide a valid email address.
Right of Withdrawal
Consumers have a statutory right of withdrawal. Further details can be found in JOLLYLIGHT’s withdrawal policy.
Prices & Payment Terms
All prices are total prices. VAT is not shown separately. Small business exemptions apply where applicable.
International deliveries may incur additional charges, such as customs duties and taxes, which are payable by the Customer.
Available payment methods are displayed in the online store.
Payment is due immediately upon receipt of payment.
Payments through Shopify Payments/Stripe are processed by Stripe Payments Europe Ltd., Dublin, Ireland.
Delivery & Shipping
Delivery is made to the address provided by the Customer.
If a shipment cannot be delivered, the Customer bears the cost of returning it.
The risk of loss or damage passes to the Customer when the goods are handed over to the shipping carrier.
Collection in person is not available.
Liability for Defects
Statutory liability for defects applies.
Governing Law & Jurisdiction
For consumers, Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the consumer’s place of residence.
For business customers, the place of jurisdiction is the Seller’s registered office.
